General terms and conditions of sale

1. Purpose

These General Terms and Conditions of Sale (GTC) govern all contractual relations between QUMAASH SA, hereinafter referred to as "the Seller", and any person making a purchase via the website www.qumaashshop.com, hereinafter referred to as "the Customer".
By placing an order, the Customer accepts these Terms and Conditions without reservation.

2. Products

The Seller offers insulated handbags and backpacks for sale.
Each product is presented with a detailed description and photographs that are as accurate as possible. However, slight variations in color or presentation may occur without incurring any liability on the part of the Seller.

3. Price

The prices displayed on the website are expressed in euros (€), including all taxes (TTC), excluding delivery charges.
The Seller reserves the right to change its prices at any time. Products are invoiced at the price in effect at the time the order is validated by the Customer.

4. Orders

Any order placed on the site constitutes a firm and final acceptance by the Customer.
The Seller reserves the right to cancel or refuse any order in the event of a dispute with the Customer (non-payment, fraud, etc.).

5. Payment

Payment is made online via the secure payment methods offered by Shopify (credit card, PayPal, etc.).
Full payment is required at the time of ordering.

6. Delivery

The products are shipped to the address provided by the Customer when placing the order.
Delivery times are given as an indication only and may vary depending on the carrier and the country of destination.
In the event of a delivery delay beyond the Seller's control (customs, strike, force majeure), the Seller cannot be held liable.

7. Right of withdrawal

In accordance with current legislation, the Customer has a period of 14 calendar days from receipt of their order to exercise their right of withdrawal.
Return shipping costs are the responsibility of the Customer, except in the case of an error attributable to the Seller.
The returned product must be in perfect condition, unused and in its original packaging.

8. Returns and refunds

After receiving and verifying the returned products, the Seller will proceed with the refund within a maximum period of 14 days.
The refund will be issued via the same payment method used for the order.

9. Guarantees

All products benefit from the legal guarantee of conformity and the guarantee against hidden defects, in accordance with the articles of the Consumer Code and the Civil Code.
The Seller cannot be held responsible for misuse, lack of maintenance or normal wear and tear of the product.

10. Responsibility

The Seller cannot be held liable for indirect damages related to the use of the products sold.
The Seller's liability is limited to the amount of the order.

11. Intellectual Property

All elements present on the site (texts, images, logos, design) remain the exclusive property of the Seller.
Any unauthorized reproduction or use is strictly prohibited.

12. Protection of personal data

The information collected during the ordering process is necessary for its processing and management.

13. Applicable Law and Jurisdiction

These Terms and Conditions are governed by French law.
In the event of a dispute, and failing an amicable resolution, the French courts shall have sole jurisdiction.
